These terms cover use of www.getmitch.ai and the getmitch waitlist. The site is operated by Orange Collar Media LLC ("we", "us"). By using the site or joining the waitlist you agree to these terms. If you don't, don't use the site.
What getmitch is right now
Today, getmitch is a public site and a waitlist. The product itself - a marketing automation tool for trades businesses - is in build. Until we open access, "use of the service" means using the marketing site and joining the waitlist. There is no paid product yet, no SLA, no guaranteed uptime.
When the product launches, separate terms will cover the SaaS service (subscription, billing, data processing, acceptable use of the app). Those will be posted at this URL and waitlist members will be emailed.
Joining the waitlist
Submitting the waitlist form is a request to be contacted about getmitch when it opens. We'll use the email you give us to send launch updates and information about the founding-member rate. You can ask to be removed at any time by emailing hello@getmitch.ai.
Founding-member pricing referenced on the site is locked for 12 months from your first paid month, provided you sign up during the founding window. We reserve the right to close the founding window at any time.
Acceptable use
Don't:
- Submit fake or stolen contact details.
- Try to break, scrape, overload, or reverse-engineer the site.
- Use the site to send unsolicited messages, spam, or anything illegal.
- Impersonate another person or business.
- Bypass any security or rate-limiting we have in place.
If you do, we can revoke access without notice and remove your data.
Intellectual property
The site - copy, design, code, the getmitch name and brand - belongs to Orange Collar Media LLC. You can't copy, redistribute, or use it for your own marketing without written permission.
Anything you submit (your business name, the email you signed up with, free-form messages) stays yours. By submitting it you give us a non-exclusive license to store and use it for the purposes set out in the privacy policy - mostly to run the waitlist and reach you.
Third-party services
The site is hosted on Cloudflare and uses Google Analytics. We don't control those providers. Their terms apply to their services.
Disclaimers
The site is provided "as is" and "as available". We don't warrant that it will be uninterrupted, error-free, or that any specific feature, price, or claim mentioned on the marketing pages will appear in the final product unchanged. Screenshots and product previews on the site are illustrative.
Nothing on the site is legal, tax, marketing, or professional advice for your business.
Limitation of liability
To the maximum extent allowed by law, Orange Collar Media LLC, its owners, employees, and contractors are not liable for indirect, incidental, special, consequential, or punitive damages arising from your use of the site or the waitlist. Our total liability for any claim relating to the site or waitlist is capped at USD $100. Some jurisdictions don't allow these limits. In those places, the cap applies to the maximum extent the law allows.
Indemnity
You agree to defend and hold us harmless against claims arising from your breach of these terms or your misuse of the site.
Termination
We can suspend or remove your waitlist record at any time, with or without notice, if we think you've broken these terms. You can leave the waitlist any time by asking us to delete your data.
Governing law
These terms are governed by the laws of the State of Colorado and the federal laws of the United States. Any dispute will be resolved in the state or federal courts in Colorado, unless local law in your country gives you the right to bring the claim somewhere else (in which case those rights aren't affected).
Changes
If we change these terms we'll post the new version on this URL and update the date at the top. Material changes will be emailed to people on the waitlist. Continued use after the change means you accept the new version.
